PUBLIC HEARING: DISCUSSION AND POSSIBLE ACTION ON A REQUEST FOR A CONDITIONAL USE PERMIT TO INSTALL AN OVERHEAD FIBER OPTIC CABLE LOCATED ON THE NORTH SIDE OF CALLE CONCORDIA, EAST SIDE OF CALLE BUENA VISTA, AND THE SOUTH SIDE OF HARDY ROAD
RECOMMENDATION:
The Planning and Zoning Commission recommends approval.
 
EXECUTIVE SUMMARY:
The purpose of this request is to consider a Conditional Use Permit (CUP) to install an overhead fiber optic cable on existing utility poles located in between the Canyon Del Oro High School and La Cañada Drive. The new cable is intended to improve broadband services for local Amphi Schools.

The applicant’s request (Attachment 1) includes:
  • Three-quarters of an inch (3/4”) thick cable
  • Installed 12” above existing utility lines and between 17’ 2”  to 26’ 1” above grade
  • 8,132 linear feet of line attached to 35 existing utility poles located along 1) north side of Calle Concordia 2) east side of Calle Buena Vista and 3) south side of Hardy Road (Attachment 2)
The Zoning Code requires applicants to obtain a CUP before installation of new utility wires over 600’ feet in length. The primary focus of the review is to ensure that the proposed overhead line does not significantly impact the existing views. On March 7, 2017, the Planning and Zoning Commission recommended approval of the request to the Town Council.
 
BACKGROUND OR DETAILED INFORMATION:
The applicant proposes to install a new overhead cable on 35 existing utility poles in the Town right-of-way. The utility poles are approximately 30-40 feet in height and contain several utility lines serving the area. The existing land uses, zoning for the site and the surrounding area are depicted in attachments 2 and 3, respectively.

  • 1974 and 1984: Annexation into the Town of Oro Valley
Existing Site Details
 
The subject property consists of multi-lane roadways with the following:
  • 35 utility poles located in between CDO High School and La Cañada Drive
    • 12 poles on north side of Calle Concordia
    • 14 poles on east side of Calle Buena Vista
    • 9 poles on south side of Hardy Road
  • Multiple above ground utility lines attached to existing utility poles
 Proposed Improvements
  • Cable is approximately three-quarters (0.77) of an inch thick
  • Installed 12” above existing utility lines and between 17’ 2” to 26’ 1” above grade
  • 8,132 linear feet of line attached to 35 existing utility poles
Review Criteria

The application was reviewed utilizing the policies established by the General Plan, Zoning Code, and Conditional Use Permit criteria. The overarching goal of the review criteria is to ensure the project is reviewed for compatibility and safety.
 
A key objective expressed in the Zoning Code is to ensure the utility lines do not significantly impact views and are placed underground when appropriate. Given that the lines and poles are pre-existing and the views of the Catalina Mountains will not be substantially diminished, this objective is satisfied. A detailed analysis of the proposed overhead cable is provided in the Planning and Zoning Commission staff report (Attachment 4).
 
Public Participation
 
Notice to the public was provided consistent with Town-adopted noticing procedures, which included the following:
  • Letter to all property owners within 600 feet
  • Posting at Town Hall
  • All registered HOAs
A neighborhood meeting was held on February 28, 2017, with two residents in attendance. The main topics discussed at the meeting included project cost, construction dates, other local jurisdictional approvals, and existing poles and wires.
 
A copy of the neighborhood meeting summary is provided as Attachment 5. No additional correspondence has been received by staff.
 
Planning and Zoning Commission Action
 
The request was considered by the Planning and Zoning Commission at the March 7, 2017 meeting. No members of the public spoke in regard to the request. The Planning and Zoning Commission recommends approval of the proposed overhead cable, finding that the request satisfies the General Plan, Zoning Code and Conditional Use Permit review criteria.

SUGGESTED MOTION:
I MOVE to approve the Conditional Use Permit to install an overhead fiber optic cable based on the finding that the proposal is consistent with the General Plan and Conditional Use Permit review criteria.
